1. Acceptance of Terms
These Terms of Service (“Terms”) govern your access to and use of the bid3bid4 website, services and auction platform.
By creating an account, accessing the website or participating in any auction, you agree to be legally bound by these Terms, the Official Auction Rules, the Payment & Delivery Policy, the After-sales & Disclaimer and all other policies published by bid3bid4.
If you do not agree to these Terms, you must not use the platform.
2. Eligibility
To use bid3bid4 you must:
- provide accurate and complete registration information;
- maintain accurate account information;
- be legally capable of entering into a binding contract under the laws of Hong Kong; and
- comply with all applicable laws and regulations.
bid3bid4 reserves the right to refuse registration or terminate any account at its sole discretion.
3. User Accounts
Users are responsible for maintaining the confidentiality of their login credentials.
All activities carried out through a registered account are deemed to have been authorised by the account holder.
Users must notify bid3bid4 immediately if they become aware of any unauthorised use of their account.
4. Identity Verification
Normal account registration and bidding do not require submission of a Hong Kong Identity Card, passport or similar identity document.
However, bid3bid4 reserves the right to request additional verification where reasonably necessary, including for:
- fraud prevention;
- suspicious bidding activity;
- unusually high-value transactions;
- legal or regulatory compliance; or
- dispute resolution.
Failure to provide requested information may result in bidding restrictions, cancellation of bids or suspension of the account.
5. High Value Bids
To protect buyers, sellers and the integrity of the auction platform, bids exceeding HK$50,000 may require prior approval by bid3bid4.
The platform may temporarily suspend, reject or delay such bids until the approval process has been completed.
Approval requirements may change from time to time.
6. Suspension and Termination
bid3bid4 may suspend, restrict or permanently terminate any account without prior notice where it reasonably believes a user has:
- breached these Terms;
- breached the Official Auction Rules;
- provided false information;
- engaged in fraud;
- manipulated auctions;
- failed to complete payment;
- abused the platform; or
- acted unlawfully.
Suspension of an account does not remove any payment obligations arising from previous auctions.
7. System Availability
Although bid3bid4 uses commercially reasonable efforts to maintain continuous operation, uninterrupted service cannot be guaranteed.
The platform may experience interruptions resulting from:
- internet failures;
- server maintenance;
- hosting providers;
- third-party services;
- software updates;
- cyber attacks;
- force majeure; or
- circumstances beyond the reasonable control of bid3bid4.
Where technical issues materially affect the fairness of an auction, bid3bid4 reserves the right to suspend, cancel, extend or restart the affected auction.
8. Intellectual Property
All content on bid3bid4, including:
- logos;
- trademarks;
- website design;
- photographs;
- text;
- graphics;
- software; and
- databases,
remain the intellectual property of bid3bid4 or the respective rights owners.
No content may be copied, reproduced, distributed or used without prior written permission.
9. Limitation of Liability
To the fullest extent permitted by law, bid3bid4 shall not be liable for:
- indirect or consequential losses;
- loss of profits;
- loss of business opportunities;
- technical interruptions;
- internet failures;
- user errors;
- third-party actions; or
- events beyond its reasonable control.
Nothing in these Terms excludes liability that cannot legally be excluded under Hong Kong law.
10. Indemnity
Users agree to indemnify and hold harmless bid3bid4, its directors, employees and affiliates from any claims, losses, damages, liabilities, costs and legal expenses arising from:
- breach of these Terms;
- misuse of the platform;
- unlawful conduct; or
- infringement of third-party rights.
11. Privacy
Collection and use of personal data are governed by the bid3bid4 Privacy Policy.
Users consent to the processing of their personal information for operating the auction platform and fulfilling legal obligations.
12. Third-Party Services
The website may contain links to third-party websites or services.
bid3bid4 is not responsible for the content, availability or practices of any third-party website.
13. Amendments
bid3bid4 may amend these Terms at any time.
Updated Terms become effective immediately upon publication on the website.
Continued use of the platform constitutes acceptance of the revised Terms.
14. Governing Law
These Terms are governed by the laws of the Hong Kong Special Administrative Region.
15. Dispute Resolution
Users are encouraged to contact bid3bid4 to resolve any dispute in good faith before commencing legal proceedings.
Any dispute arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts of the Hong Kong Special Administrative Region.
16. Entire Agreement
These Terms, together with the Official Auction Rules, Payment & Delivery Policy, After-sales & Disclaimer and Privacy Policy, constitute the entire agreement between the user and bid3bid4 regarding use of the platform.
